What follows is an introduction to some of the main Canadian Visa programs currently available.

Business Visas allow business people to visit Canada for a short period of time for the purpose of developing their business by investment or the creation of short or long term business relationships with Canadian counterparts.

This visa was created to promote Canada's economic development and foster domestic employment. A Business Visa permits potential investors, entrepreneurs and/or self-employed people with the desired business abilities to immigrate to Canada.

Successful people with knowledge and experience of foreign markets can find new and exciting opportunities in Canada – a country that is still developing commercial opportunities throughout the world's emerging markets. Individuals with the relevant backgrounds and sufficient net worth are invited to apply for permanent residence through one of a number of different Visa Programs. These include Canada's two federal programs: Entrepreneur Start-up Visa program, Self-Employed Persons program– as well as Quebec and British Columbia's Provincial Nominee Program’s Entrepreneur Immigration categories.

Business Immigration Programs

Are you self-employed, an entrepreneur or involved in a start up? Canada has a business immigration program designed specifically for you. There are two main areas of the business immigration programs-

  1. The self-employed program

  2. The start up program

The self-employed program

To qualify for business immigration to Canada under the Self-employed Program, an applicant must demonstrate that they have the relevant experience that has allowed them to be self-employed while living in their country of origin. The candidate must also be able to make a significant contribution to one of these fields through their relevant experience and skills in Canada.

In order to qualify as a self-employed person, you must have at least two years of relevant experience and show that you intend to become self-employed in Canada. You must score at least 35 points on a selection grid designed to determine whether you will be able to make an economic contribution to Canada. 

The selection for the visa is based on:

The documents provided, the score under each of the selection criteria and meeting the definition of a self-employed person. There might also be an interview to explain any information that is unclear or inconsistent and any shortcomings or gaps in the documents that are provided

If there’s a difference between your statement of your qualifications and the visa officer’s assessment, award points will be based on the officer’s decision.

There are 5 selection criteria 

  1. Education

  2. Experience

  3. Age

  4. Ability in English and/or French

  5. Adaptability

You and your family members must have a medical exam and get police certificates.

You must also show that you have enough money to support yourself and your family after you get to Canada. The good news is that there is no regulated minimum net worth requirement. However, you will have to satisfy a visa officer that you have enough money to settle in Canada with your dependants and finance the work on which your selection was based.

The start-up program

The Start-up Visa Program is a general Investor Visa option that allows you to immigrate to Canada by starting a business anywhere in the country. You and your business will have to meet a set of requirements in order to be successful with your application. In general, your business must be innovative, create jobs for Canadians and be able to compete internationally. While you wait for your application’s approval, you can also apply for a temporary work permit to keep you busy in Canada.

The start-up program

In order to qualify for this program, you will need to comply with the following:

Designated Organisations

There is a list of designated organisations that are approved to invest in or support possible start-ups through the Start-up Visa Program. Those are -

  • Canadian venture capital funds who are required to invest at least $200,000.

  • angel investor groups who are required to invest at least $75,000.

  • business incubators.

In order to apply for this visa each applicant must have a qualifying business with a commitment from a designated organization. 

This means that each applicant must hold 10% or more of the voting rights attached to all shares of the corporation outstanding at that time (up to 5 people can apply as owners).  

The applicants and the designated organization must jointly hold more than 50% of the total voting rights attached to all shares of the corporation outstanding at that time.

At the time of receiving permanent residence the applicants must provide active and ongoing management of this business from within Canada. An essential part of the operations of the business must happen in Canada and the business needs to be incorporated in Canada

Letter of support and commitment certificate

In order to qualify for the start up program you will need to get a commitment from one of the above designated organisations, who will supply your business with a letter of support. The letter of support is the proof you need to show that the venture capital fund, angel investor group, or business incubator is supporting your business idea. The organization will also send a commitment certificate directly to the Canadian Immigration Authority who will use the letter of support and the organization's commitment certificate to assess your application. 

If you don’t include the letter of support or meet any of the other requirements, your application can be refused.

Language requirements

The ability to communicate and work in English, French or both languages will help your business succeed in Canada.

You must take a language test from an approved agency and include the results with your application. You must meet the minimum level of the Canadian Language Benchmark (CLB) 5 in either English or French in all of these four areas:

  • speaking.

  • reading.

  • listening.

  • writing.

Bring enough money to settle

The Government of Canada does not provide financial support to new start-up visa immigrants. When you apply, you’ll need to provide proof that you have enough money to support yourself and your dependents after you arrive in Canada. You can’t borrow this money from another person.

Once you have complied with the above you can apply for the Start-up visa.

The Skilled Worker Visa is designed to allow immigrants to Canada as permanent residents without the prior requirement of a sponsor or employer.

Canada offers opportunities for Skilled Workers who wish to immigrate. Skilled Workers (i.e, qualified professionals as well as experienced tradespeople) and their families are invited to settle permanently in Canada if their immigration application is successful.

Canada is always looking to welcome Skilled Workers, and a wide variety of both Federal and the Provincial visa programs exist to facilitate their immigration. These include the Express Entry Program, Federal Skilled Worker Programs, as well as Provincial Nominee Programs.

Express Entry is the fast-track system introduced to enable prospective immigrants with a specific skill or experience to complete the immigration process in about six months through the Federal Economic Programs.

The Express Entry is the most pursued pathway for Canadian Visa application.

This is the new fast-track system introduced by the Immigration, Refugees and Citizenship Canada (IRCC) agency in January 2015. The aim is to allow potential immigrants with needed skills and backgrounds to complete the immigration process in the shortest possible time.

How it Works

Express Entry is a multi-factored 'pool and points' system that the IRCC uses to select the most suitable candidates for immigration to Canada.

Applications are measured according to a whole range of personal information that is required to be provided. This builds your 'Applicant's Profile'.

To build this profile you will be asked about your: 

  • educational and/or professional qualifications as well as those of your spouse/partner if relevant.
  • work experience.
  • language abilities.
  • age.
  • family situation.

If nominated, you will be asked whether you already have a specific job offer in Canada from a qualifying employer, as well as other factors.

Based on your answers, the system awards points according to what is called the Comprehensive Ranking System (CRS) and your total score will be calculated. The score is calculated out of a possible maximum of 1200.

Canada's immigration authorities then select the most suitable candidates from the pool and offers them an official 'Invitation to Apply' (ITA) for one of those immigration programs. The higher your score the better your chances of being selected.

Once you receive an ITA, you have a maximum 90-day period during which to submit the full online application for permanent residence.

The Canadian government through Citizenship and Immigration Canada is committed to processing complete applications within 6 months of submission. Candidates can remain in the Express Entry pool for up to 12 months and if they do not receive an invitation within this period, may submit a new profile.

Programs covered by Express Entry

Express Entry is applicable for the following groups of applicants:

  • Federal Skilled Worker Class which includes doctors and engineers etc.
  • Federal Skilled Trades Class designed for welders and plumbers etc.
  • Canadian Experience Class, for people who have already lived, worked or studied in Canada.
  • Provincial Nominee Programs – these are run by some but not all Provinces.

This Visa allows people to enter Canada for a period of up to 6 months, for a holiday, work or family visit.

A Visitor or Tourist Visa allows you to enter Canada on a temporary basis for a period of up to 6 months, for the purpose of a holiday, work or family visit.

You must have a valid Visitor Visa before you enter Canada, unless arriving by air from visa exempt countries. In such cases you are required to have a valid Electronic Travel Authorisation (ETA) before entering the country. Your Visitor Visa may be issued to cover a single or multiple entries to Canada.

  • The single-entry visa is valid for 6 months and may be used on just one occasion. if you leave the country – even before the end of the 6-month period – you will need to apply for a new visa before you can re-enter Canada. 
  • A Multiple Entry visa is issued valid for a period of up to 10 years. This may be used for re-entry up to one month before your passport or Multiple Entry visa expires (whichever is the earlier).

A Working Holiday Visa enables people to work and travel in Canada for a period of up to 24 months.

A Working Holiday Visa allows young people from the 32 countries with bilateral youth agreements with Canada, who are between the ages 18 and 35, to work and travel in Canada for a period of up to 2 years.

Working Holiday Visa holders can work for any Canadian employer in any part of the country. A specific job offer prior to making your application is not needed.

Bear in mind that not all jobs are open to Working Holiday Visa holders, particularly those which require specific certification such as education, health and others.

Student Visas is a great way for international students to enroll in a Canadian institute of higher education with the option of applying for permanent residence after graduation.

Each year Canada issues more than 130,000 Student Visas for foreign nationals to study at its globally recognised centres of higher education.

In a recent study by the Times Higher Education World University Rankings, out of 1,000 universities Canada had 5 universities ranked in the top 100, 10 in the top 250, and 19 in the top 500. 

According to the International Student Survey conducted by the Canadian Bureau for International Education, over 90% of those in higher education were satisfied or very satisfied with their studies in Canada, and 95% would recommend Canada as a place to study.

Upon graduating, international students may apply for a work permit under the Post-Graduate Work Permit Program.

Eligibility

To be eligible, foreign students wishing to study in Canada need to meet the following criteria:

  • be accepted to study at an approved Canadian institution.
  • prove that they have sufficient funds to pay for tuition fees, living expenses, and return transport after the completion of their study program.
  • provide proof (valid police certificate) stating that they are law-abiding citizens with no criminal record and that therefore are not a security risk to Canada.
  • be in good health and willing to undertake a medical examination should that be deemed necessary.
  • satisfy immigration authorities that they will indeed leave Canada upon completion of the study program and their authorized stay.

 

In some cases, a Student Visa is not required. This applies when the course program lasts less than two months, if you belong to the staff of a foreign representative to Canada or a family member of and if you are a member of a foreign armed force.

The Temporary Visa was designed to enable people to visit Canada for holiday, work or study for a short period of time or for an extended visit but not for work or study purposes. The requirements for eligibility and the possible length of stay are dependent upon each individual's particular circumstances as well as their country of origin.

The Family Visa enables Canadian citizens and permanent residents to sponsor their immediate family and relatives to live, work and study in Canada.

Family Visas enable Canadian citizens and permanent residents over the age of 18 to sponsor their immediate family and relatives to join them to live, work and study in Canada.

This includes a spouse or common-law partner, dependent children, parents and grandparents, orphaned siblings, nephews and nieces, grandsons and granddaughters (under the age of 18 and not married or in common-law partnership), as well children in process of international adoption.

The Canadian immigration authorities have created several different Family Sponsorship Visa options to enable families to reunite and build a new life in a safe and welcoming country.
